Beyond the Experience: Booking Terms & Conditions for Yacht Charters and Catamaran Tours
- Reservation Agreement: By booking a tour with Beyond the Experience, a division of BEYOND EXPERIENCE S de RL de C.V., you acknowledge having read and accepted these terms, which are detailed on our rate sheet and website. The individual making the booking, henceforth referred to as the "Charterer," assumes responsibility for all costs associated with the vacation. A binding contract is established once we issue your invoice, which should be reviewed for accuracy upon receipt.
- Payment Terms: An initial deposit of 50% of the charter fee is required at booking. The remaining balance is due upon arrival at the pier before boarding.
- Cancellation and Changes: Beyond the Experience reserves the right to cancel or modify tours due to weather conditions, with decisions made by our experienced team and communicated in advance. In case of cancellations not rescheduled, a full refund will be provided. Changes initiated by the Charterer, such as alterations in dates, destinations, or selected yacht, are treated as cancellations. Failure to meet payment deadlines may result in cancellation, with all deposits forfeited.
- Yacht Delivery: We guarantee to deliver the selected yacht in full working order and equipped for service. In unforeseen circumstances where the original yacht is unavailable, we may substitute a similar or superior yacht. Acceptance by the Charterer confirms the yacht meets expectations. If we cannot provide a yacht within 24 hours of the agreed time, a full refund is offered.
- Accidental Damage and Liability: Illegal substances are strictly prohibited on our yachts. The Charterer assumes risk associated with alcohol or drug use, and Beyond the Experience is indemnified against any claims arising from such use. Our comprehensive insurance covers the yacht and equipment, but personal loss or damage is the Charterer's responsibility.
- Swimming and Diving: Beyond the Experience is not liable for accidents or injuries related to water activities. Charterers engage in these activities at their own risk.
- Running Expenses: The Charterer is responsible for any additional expenses incurred during the charter, not covered by the package.
- Restricted Use: The yacht is for pleasure use within the specified cruising area. Any deviation requires prior approval from Beyond the Experience. Night sailing and rafting to other vessels are prohibited.
- Termination and Indemnity: Beyond the Experience may terminate the charter if the Charterer or their party engages in illegal activities, violates safety regulations, or displays improper conduct, without any refund. The Charterer indemnifies Beyond the Experience against any claims related to the charter.
- Crew and Skipper: A competent skipper/guide can be provided upon request, and the Charterer should respect their judgments on navigation and safety.
- Miscellaneous: Beyond the Experience acts on behalf of the yacht owner and is not liable for any loss, damage, or injury arising from the Charterer's use of the yacht. The Charterer agrees to indemnify Beyond the Experience and the yacht owner against all claims.
